A MAN was found lying in the street, drunk and holding a knife in Menstrie.
Lee Johnson, of Johnstone Street, Menstrie, appeared for sentencing at Alloa Sheriff Court.
The 35-year-old admitted that on February 13 at Windsor Street, Menstrie, he was unlawfully in possession of a knife.
Depute fiscal Sean Iles said that at 7pm a driver stopped their car and went to Johnson’s assistance as he was lying on the ground.
Other people in the area also went to see what was wrong with him.
They saw he was holding a knife and this was taken from him.
Police were called to the scene and when arrested, Johnson said: “Can you prove I had a knife?”
Defence solicitor Robert Smith said his client, who is unemployed, “had consumed a significant amount of alcohol that day”.
The solicitor added: “He had fallen over and knocked himself unconscious in the street. After an argument, he had left the house with a Stanley knife and was planning to self-harm.”
The court heard Johnson is already on a community payback order.
Sheriff Garry Sutherland imposed another community payback order with 12 months of supervision. He also fined Johnson £320.
